3. SMS Communications

ReviewRover provides tools that allow businesses to send SMS and email communications to their customers for purposes such as collecting reviews and sending notifications. When using ReviewRover to send communications, our customers (the businesses) are solely responsible for ensuring compliance with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) for SMS communications, CAN-SPAM Act for email communications, and any other relevant regulations.

  • Obtaining Consent: Our customers are required to obtain prior, explicit consent from their customers before sending any SMS or email messages through the ReviewRover platform. This includes, but is not limited to, obtaining written or electronic consent to send marketing or service-related communications.
  • Opt-Out Mechanism: ReviewRover provides tools to assist customers in managing opt-out requests. However, it is the responsibility of our customers to provide their end-users with a clear and accessible opt-out mechanism (e.g., replying “STOP” to SMS messages or including an unsubscribe link in emails). Our customers must comply with all opt-out requests immediately to ensure that further communications are not sent to those users.
  • Data Collection: Our customers may collect personal data, including phone numbers and email addresses, from their own customers in order to send communications. ReviewRover acts as a data processor in this context, meaning that our customers are responsible for managing, securing, and protecting this data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable.
  • Compliance: Our customers are responsible for ensuring that all communications sent via ReviewRover comply with all applicable laws and regulations, including but not limited to TCPA, GDPR (if applicable), and the CAN-SPAM Act. ReviewRover assumes no responsibility for the legality of messages sent by our customers and strongly encourages them to consult with legal counsel to ensure compliance.

4. Sharing Your Information

We do not sell your personal information. However, we may share your data under the following circumstances:

  • With service providers who help us operate our platform, such as Twilio for SMS communications.
  • In compliance with legal obligations, such as a court order or government regulation.
